All content on this site — including the Vibe Supplements name, NeuroSpark branding, logos, product designs, photography, copy, formulations, label artwork, and software — is owned by Vibe Supplements or its licensors and is protected by U.S. and international intellectual property laws.

We grant you a limited, revocable, non-exclusive, non-transferable license to view and use the site for personal, non-commercial purposes. No other rights are granted by implication, estoppel, or otherwise.

You agree NOT to:

• Scrape, crawl, harvest, or otherwise extract data from the site by automated means without our prior written permission.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of any portion of the site or our software.
• Use the site to send spam, unsolicited marketing, chain messages, or bulk communications.

We may suspend or terminate your access at any time for suspected violations, and we may report unlawful activity to law enforcement.

All orders are subject to acceptance and product availability. We reserve the right to refuse or cancel any order — including for pricing errors, suspected fraud, or shipping restrictions — and to limit quantities. Prices and promotions may change without notice and are not retroactive.

Title and risk of loss pass to you upon delivery to the carrier. Estimated delivery dates are not guaranteed. Returns, refunds, and exchanges follow our published policy on the product or checkout pages; perishable, opened, or final-sale items may not be eligible.

Payment is processed by third-party providers (such as Shopify Payments, Stripe, or PayPal). By submitting an order you authorize us and our processors to charge your chosen payment method for the order total, taxes, and shipping.

Our products are dietary supplements, not drugs. Statements about our products have not been evaluated by the U.S. Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease.

TO THE FULLEST EXTENT PERMITTED BY LAW, VIBE SUPPLEMENTS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL — ARISING FROM YOUR USE OF THE SITE OR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR ANY PRODUCT WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE 6 MONTHS BEFORE THE CLAIM, OR (b) USD $100.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of certain damages, so portions of this section may not apply to you.

You agree to indemnify and hold harmless Vibe Supplements and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from (a) your use of the site, (b) your violation of these Terms, or (c) your violation of any law or third-party right.

Informal resolution first. Before filing a claim, you agree to contact us at support@vibesupp.com and attempt to resolve the dispute informally for 30 days.

Binding arbitration. Any unresolved dispute will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, in Florida, USA, or via video conference. The arbitrator's decision is final.

Class-action waiver. You and Vibe Supplements agree to bring claims against the other only on an individual basis, and not as a plaintiff or class member in any class, collective, or representative action.

Small-claims & opt-out. You may bring an individual claim in small-claims court if it qualifies. You may opt out of arbitration by emailing us within 30 days of first accepting these Terms.

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. Subject to the arbitration section above, the exclusive venue for any permitted court action is the state or federal courts located in Florida, and you consent to personal jurisdiction there.

We may update these Terms from time to time. The "Last updated" date above reflects the current version. Material changes will be highlighted on this page or communicated by email where appropriate. Your continued use of the site after a change takes effect constitutes acceptance of the updated Terms.
